These Terms of Service govern your access to and use of WeldSuite, operated by WeldReach B.V. By accessing or using our services, you agree to be bound by these Terms.

By accessing and using WeldSuite, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our services.
If you are using WeldSuite on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and the organisation.
You must be at least 18 years old and capable of entering into a legally binding agreement to use our services. If you are under 18, you may only use WeldSuite with the involvement and consent of a parent or legal guardian.
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account credentials and must not share your login details with others.
You are responsible for all activities that occur under your account, whether or not you have authorised them. You must notify us immediately at [email protected] of any unauthorised access or security breach.
WeldSuite grants you a limited, non-exclusive, non-transferable, revocable license to access and use our software services in accordance with these Terms and your selected subscription plan.
This license does not include the right to modify, copy, or create derivative works based on our software; reverse engineer, decompile, or disassemble any part of the service; sublicense, sell, resell, or redistribute the service; use the service for any illegal or unauthorised purpose; or remove or alter any proprietary notices or labels.
You may use WeldSuite for legitimate business and personal productivity purposes, integrate WeldSuite with your other tools and applications via supported methods, invite team members to collaborate within your workspace, and export your data at any time through supported export features.
You may not transmit malware, viruses, or any harmful or disruptive code; attempt to gain unauthorised access to our systems or other users' accounts; use the service to send spam, phishing, or unsolicited communications; interfere with or disrupt the integrity or performance of the service; scrape, crawl, or use automated means to access the service without permission; use the service to store or transmit content that infringes on any third party's rights; or violate any applicable local, national, or international law or regulation.
WeldSuite offers both free and paid plans. Free plans include limited features and usage. Paid plans offer additional functionality, storage, and support as described on our pricing page.
Paid subscriptions are billed in advance on a monthly or annual basis depending on your plan selection. All fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.
We reserve the right to modify pricing with at least 30 days' notice. Price changes will not affect existing paid subscriptions until the next renewal period.
Payments are generally non-refundable except as required by Dutch or EU consumer protection law. If you cancel a paid plan, you will retain access to paid features until the end of your current billing period.
We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible.
You retain all rights to your data. We do not claim ownership of any content you upload, create, or store within WeldSuite.
You grant us a limited, worldwide, non-exclusive license to use, store, and process your data solely for the purpose of providing, maintaining, and improving our services.
We process your data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). Your data is stored on servers within the European Union.
You may export your data at any time through your account settings. We support standard export formats to facilitate data portability.
Upon account termination, your data will be permanently deleted within 30 days, unless we are legally required to retain it for a longer period. You may also request deletion of specific data at any time.
The WeldSuite platform, including its design, features, functionality, source code, documentation, and all related intellectual property, is owned by WeldReach B.V. and protected by international copyright, trademark, and other intellectual property laws.
"WeldSuite", "WeldProjects", "WeldMail", and the WeldSuite logo are trademarks of WeldReach B.V. You may not use our trademarks without prior written permission.
If you provide feedback, suggestions, or ideas about our services, you grant us the right to use them without restriction or compensation.
WeldSuite may integrate with or provide access to third-party services, applications, and websites. Your use of such third-party services is governed by their own terms of service and privacy policies.
We do not endorse, warrant, or assume responsibility for any third-party services. Any interactions, transactions, or disputes between you and a third-party provider are solely between you and that provider.
When you enable a third-party integration, you authorise us to share the necessary data with that service. You can revoke access to third-party integrations at any time through your account settings.
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted, secure, or error-free service. We are not responsible for any loss of data due to technical failures beyond our reasonable control. Any AI-generated content or suggestions within WeldSuite are provided for assistance only and may not always be accurate or complete. We do not warrant that the service will meet your specific requirements. You are responsible for ensuring your use of the service complies with all applicable laws and regulations.
To the maximum extent permitted by Dutch law, WeldReach B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill. Our total aggregate liability shall not exceed the amount paid by you to us in the 12 months preceding the event giving rise to the claim. For free plan users, our total liability is limited to EUR 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Dutch law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
You agree to indemnify, defend, and hold harmless WeldReach B.V. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the service, your violation of these Terms, your violation of any third-party rights including intellectual property or privacy rights, or any content you upload, submit, or transmit through the service.
You may terminate your account at any time through your account settings or by contacting us at [email protected]. Termination does not entitle you to a refund for any prepaid fees.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice where reasonably practicable, except in cases of severe violations.
Upon termination, your right to use the service ceases immediately. We will delete your data within 30 days unless legally required to retain it. Sections of these Terms that by their nature should survive termination will continue to apply, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands.
For consumers in the European Union, this does not affect your statutory rights under local consumer protection laws or your right to bring proceedings in the courts of the member state in which you are domiciled.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the service at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the modified Terms. If you do not agree to the revised Terms, you must stop using the service before the changes take effect.
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and WeldReach B.V. regarding your use of WeldSuite. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, cyberattacks, pandemics, or other force majeure events.
